{"id":4125,"date":"2020-04-27T07:28:57","date_gmt":"2020-04-27T05:28:57","guid":{"rendered":"http:\/\/us-patente.com.www243.your-server.de\/?page_id=4125"},"modified":"2022-09-02T17:06:57","modified_gmt":"2022-09-02T15:06:57","slug":"u-s-patent-interference","status":"publish","type":"page","link":"https:\/\/us-patente.com\/en\/our-services\/u-s-patent-interference\/","title":{"rendered":"U.S. Patent Interference"},"content":{"rendered":"<div class=\"container-fluid\"><div id=\"element_1177609365737\" class=\"el_row row\"><div class=\"inner-row\"><div id=\"element_2\" class=\"el_column col-md-12\"><div class=\"inner-column\"><div id=\"element-3\" class=\"section-head left\"><div><h2 class=\"section-main-title\">U.S. PATENT INTERFERENCE<\/h2><\/div><\/div><div id=\"element_4177609365795\" class=\"el_text\"><p>An interference proceeding is a dispute between a U.S. patent application and either another U.S. patent application or a U.S. patent issued no more than one year earlier.\u00a0 The patent applications or patent involved in this proceeding are characterized by patent claims that are nearly identical, i.e., two parties claim the same invention.\u00a0 Under U.S. Statutes, a patent may be issued only once and to the rightful inventor.\u00a0 An interference proceeding is thus declared to determine which of the parties first invented the jointly claimed invention, because only that party can be granted the corresponding U.S. patent.\u00a0 Once an interference proceeding is proposed by either a patent examiner or by one of the parties, the patent examiner refers the proposed interference proceeding to a special committee in the U.S. Patent and Trademark Office (USPTO).\u00a0 An administrative patent judge initiates the interference proceeding, which is then guided by the committee. \u00a0What follows can be described as &#8220;litigation in the patent office.&#8221;\u00a0 This procedure is tightly organized, yet lengthy, costly, and requires specialized knowledge.\u00a0 After several written exchanges and oral hearings, a panel of committee members makes a final judgment on issues of priority and patentability.\u00a0 This judgment can be appealed in a court outside the USPTO.<\/p>\n<p>After the USPTO switched to a &#8220;first inventor-to-file&#8221; system under the America Invents Act (AIA) of 2013, under which simply the date of the day the patent application was filed determines who made the invention first, interference proceedings are quite rare these days.\u00a0 Yet, they still exist.<\/p>\n<p>If your already filed U.S. patent application is still under examination and is included in an interference proceeding, please <a href=\"\/en\/contact\/\">contact us<\/a>.
